Article 1. – General Provisions – Contact details of the website owner

These terms and conditions (hereinafter “Conditions”) apply to the use of all websites (including mobile sites), as well as the elements and applications, created or owned by the entity whose full contact details are provided on the “contact” page (hereinafter “the Company”) (hereinafter referred to as the “Sites”).

The term “user” refers to any person accessing the Sites (hereinafter “User”).

By using the Sites, the User fully and unconditionally accepts the applicable Conditions and agrees to comply with them.

If the User disagrees with the Conditions, they must refrain from using the Sites and/or Services.

In case of non-compliance with the Conditions, the Company reserves the right to deny access to the Sites, without prejudice to its right to claim compensation from any third party for any direct or indirect damage resulting from this non-compliance.

The Company reserves the right to partially or fully modify the Terms of Use at any time without prior notice.

It is therefore recommended to regularly review the Terms of Use to stay informed of the most recent version.

Article 2. – Use of the Sites

The use of the Sites is generally free and unrestricted. To use certain Sites, the User must register, provide certain data, and/or create an access code and/or password.

If the User refuses, access to the relevant parts of the Sites will not be possible.

In the case of paid access to certain Sites, the User will be informed in advance, including the applicable conditions, prices, and payment method.

The Company grants the User a non-exclusive and non-transferable license for an indefinite period, allowing the User to download the content of the Sites solely for the purpose of displaying it on a single computer.

This license, however, is revocable at any time, without justification.

The User may also print a copy of the content from the Sites for personal use, provided that no modifications are made to the content.

The Sites may only be used for personal and private purposes by individuals and exclusively for internal purposes by professionals.

Therefore, any commercial use of the Sites is strictly prohibited.

Users agree not to take any actions that may destroy or disrupt the proper functioning of the Sites.

In the event of abuse or improper use, the Company reserves the right to suspend and/or terminate the User’s access to the Sites without prior notice or warning.

Article 3. – Copyright and Database Producer Rights

All copyright, trademarks, patents, intellectual property rights, and other applicable ownership rights related to the Sites belong at all times to the Company.

The Sites and/or Services constitute both a work protected by copyright and databases on which the Company holds the copyright and producer rights.

The texts, layout, designs, photos, films, graphics, and other elements of the Sites are protected by copyright.

The copying, adaptation, modification, translation, arrangement, public communication, rental, or any other form of exploitation of all or part of the Sites, in any form and by any means, including electronic, mechanical, or otherwise, is strictly prohibited without the prior written consent of the Company.

Any violation of these rights is subject to civil or criminal prosecution.

Article 4. – Trademarks and Trade Names

The names, logos, and other signs used on these Sites (including the Company’s logos and trade names) are legally protected trademarks and/or trade names.

Any use of these or similar signs is strictly prohibited without the prior written consent of the Company.

Article 5. – Liability

The Company will make every effort to ensure the proper functioning of the Sites.

Except in cases of intentional misconduct and/or mandatory legal provisions to the contrary, the Company disclaims any responsibility for any loss or damage (direct, indirect, material, immaterial, etc.) resulting from:

(1)The content of the Sites. The Company does not guarantee the accuracy, adequacy, or completeness of the information on the Sites. Information available on the Sites, including that relating to products and services offered for sale, may be subject to change without prior notice. The Company takes great care in creating, updating, and maintaining the site. If the User notices any inaccurate or outdated information or harmful or illegal content, or believes that one of their rights (intellectual or otherwise) has been violated, they are strongly encouraged to report it;

(2)The use of the Sites;

(3)The security of the Sites. This provision applies particularly to potential viruses, errors, or computer fraud;

(4)The accessibility/availability of the Sites. The Company does not guarantee the continuous availability, through all technical means, without error or interruption, of all the functions of the Sites, nor the immediate repair of errors or the immediate restoration of interruptions.

The Company also reserves the right to refuse access to the Sites and Additional Services or terminate access at any time and without prior notice.

The Company cannot in any way be held responsible for services and/or products, or their billing, if they are offered by third parties and accessible via the Sites, even if the

Company receives a fee for this or manages the billing of these services and/or products on behalf of third parties.

In cases where the Company’s liability is engaged, its liability is limited to the amount of €100.00. The above-mentioned limitations and/or exclusions of liability on the part of the Company apply to the extent that they are valid under applicable law.

Article 6. – Privacy – Processing of Personal Data

The Company and the User commit to complying with applicable regulations regarding the processing of personal data, particularly Regulation (EU) 2016/679 of the European Parliament and the Council of 27/04/2016 (GDPR).

The Company collects and processes identity data and contact details it receives from the User and any other relevant contact persons. The purposes of these processing activities are the execution of a contract, client management and order processing, accounting, and direct marketing activities, such as sending promotional or commercial information. The legal bases are contract execution, the User’s consent, compliance with legal and regulatory obligations, and/or the legitimate interest of the Company.

The aforementioned personal data will be processed in accordance with the provisions of the General Data Protection Regulation and will only be shared, unless further consent is provided by the User, with subcontractors, recipients, and/or third parties to the extent necessary for the above-mentioned purposes.

The User is responsible for ensuring the accuracy and updating of the personal data provided to the Company and commits to strictly adhering to the provisions of the General

Data Protection Regulation concerning the individuals whose personal data they have provided, as well as any personal data they may receive from their own clients.

Personal data will be stored and processed for a period necessary according to the purposes of the processing and the relationship (contractual or not). In all cases, the data of

Users will be removed from our systems after 7 years or, in the case of a contract, after 7 years following its completion, unless the personal data needs to be kept for a longer period based on specific legislation or in the event of ongoing litigation where the personal data is necessary.

By agreeing when entering or communicating their personal data or by voluntarily continuing to browse the Sites or when concluding a contract with the Company, the User consents, in addition to the processing defined above, to the collection and use of their personal data as described below.

The Company collects personally identifiable information (name, address, phone number, email address, VAT number, total visits to the site, number of visitors on each page, domain names of internet service providers, IP addresses, cookies).

The User agrees that their data may be used and shared with third parties for advertising, commercial, or marketing purposes and consents to receiving information from the Company or its partners by email (newsletters, etc.) or by postal mail.

Right of Access: The User has the right to request at any time if their data has been collected, for how long, and for what purpose.

Right of Rectification: The User has the right to request that any incorrect or incomplete data be corrected or supplemented at any time upon request.

Right to Limit Processing: The User may request a limitation on the processing of their data. This means that the data in question must be “marked” in our system and cannot be used for a certain period.

Right to Erasure (“Right to be Forgotten”): Subject to exceptions provided by law, the User has the right to request that their data be erased. If the User wishes to deactivate the possibility for the Company to process their personal data, they simply need to write to the address specified in Article 1.

Right to Data Portability: The User may request that their data be provided to them in a “structured, commonly used, and machine-readable format.”

Right to File a Complaint: The User may file a complaint with the data protection authority.

The Company commits to implementing technical and organizational measures that guarantee an adequate level of security to protect the confidentiality of the data. The Company will notify the client of any personal data breach it becomes aware of.

Article 7. – Hyperlinks

The Site may include links to other websites. As the Company cannot control these sites, it cannot be held responsible for the availability of these sites. It is also not liable for the content, advertisements, products, services, or any other material available on or from these sites. Furthermore, the Company cannot be held responsible for any proven or alleged damages or losses resulting from or in connection with the use of or reliance on the content, goods, or services available on these sites.

Article 8. – Cookies

A cookie is a small text file saved by the server of a website in your browser when you visit the site, either temporarily (session cookie) or for future visits (persistent cookie).

Cookies may be placed by the server of the website you visit or by partners with whom the website collaborates. The server can only read cookies that it has placed itself; it does not have access to any other information on your computer or mobile device. Cookies are stored on your computer or mobile device in the browser directory.

Typically, the content of a cookie includes the name of the server that placed it, an expiration date, and a unique encrypted code. Company permission to reproduce these Contributions on the Sites and make them public on the internet worldwide and without any time limitation, without any financial compensation or other consideration.

Users are solely and fully responsible for the content of their Contributions and for any consequences of their dissemination via the Sites. Users guarantee that they possess all necessary rights and/or permissions to publish their Contributions on the Sites as described above.

Users shall indemnify the Company against any claims, complaints, or actions by third parties or any regulatory body related to their Contributions.

The Company does not exercise prior control over Contributions. However, it reserves the right not to publish or to remove from its Sites any illegal Contribution, or any

Contribution that reasonably appears to infringe third-party rights, without notifying the User who submitted the content in question.

Article 10. – Jurisdiction and Applicable Law

Belgian law applies to the Sites, and the courts of the judicial district of the Company’s registered office shall have exclusive jurisdiction in the event of disputes arising from the use of the Sites.
